HealthPhi Terms of Use

These Terms of Use (“Terms”) explain the rules for using the HealthPhi mobile app, website, and related services (“HealthPhi,” “we,” “us,” or “our”). By downloading, accessing, or using HealthPhi, you agree to these Terms. If you do not agree, please do not use the app.

1. What HealthPhi Is

HealthPhi helps you understand your health, fitness, nutrition, and mindfulness information in one place. We provide:

    • Health summaries and trends

    • Nutrition, fitness, and lifestyle insights

    • Goal tracking

    • Access to connected Electronic Health Record (EHR) data

    • AI-powered interpretations of your data

    • Visualizations and dashboards

HealthPhi does not provide medical care. We do not diagnose conditions, treat illnesses, or provide professional medical advice. If you feel unwell or have a medical question, please contact a qualified healthcare provider.

2. Who Can Use HealthPhi

To use HealthPhi, you must:

    • Be 18 years or older

    • Live in the United States (or understand the app is built for U.S. use)

    • Have the legal right to enter into this agreement

    • Use the app only for personal, non-commercial use

3. Your Account

You may need to create an account to use some features.
You agree to:

    • Provide accurate information

    • Keep your login secure (biometrics, passcode, etc.)

    • Not share access with others

    • Notify us if you suspect unauthorized use

We may suspend or close accounts that violate these Terms.

4. License to Use the App

When you download HealthPhi, we give you a limited, non-exclusive, non-transferable license to use the app on your personal device.

You may not:

    • Copy the app

    • Reverse-engineer, modify, or resell the app

    • Interfere with the app, servers, or networks

    • Attempt to access data that is not yours

    • Use the app for harmful, unlawful, or fraudulent purposes

All intellectual property—including app design, text, graphics, software, analytics, and AI models—belongs to HealthPhi.

5. HealthKit and Apple Compliance (Required by Apple)

If you choose to share Apple Health / HealthKit data:

    • HealthPhi uses HealthKit data only to show health insights

    • We do not use HealthKit data for advertising or marketing

    • HealthKit data is not sold or shared with third parties

    • You can turn off access at any time through Apple Health settings

6. FHIR and EHR Data Disclaimer

If you link your health provider accounts:

    • HealthPhi retrieves FHIR data directly from third-party systems

    • HealthPhi is not responsible for errors, omissions, or delays in EHR data

    • HealthPhi does not alter medical records

    • Providers control the accuracy and availability of FHIR data

This app displays medical information but does not interpret it medically. Always consult your healthcare provider for clinical interpretation.

7. AI-Generated Insights (Important Disclaimer)

HealthPhi uses algorithms, statistical models, and artificial intelligence to generate trends and insights based on your data.

These insights:

    • Are informational only

    • Are not medical advice

    • Are not a substitute for professional care

    • Should not be used to diagnose or treat any condition

    • May sometimes be incomplete or incorrect

    • Should be discussed with a qualified health provider if you have concerns

8. AI Model Training & Data Use

We may use de-identified and aggregated data to:

    • Improve HealthPhi

    • Train algorithms

    • Develop new health features

    • Enhance accuracy of trends and insights

    • Support wellness research

We never use identifiable personal or HealthKit data to train external or commercial AI models.
We do not sell data.

9. Subscription, Billing, and Refunds

A. Subscription Through the Apple App Store

    • HealthPhi may charge a monthly or yearly subscription fee

    • Billing is handled by Apple, not HealthPhi

    • Subscriptions renew automatically unless you cancel in the App Store

    • You can cancel anytime through your Apple ID settings

B. Refunds

HealthPhi does not provide refunds.
Refunds are managed directly by Apple, following Apple’s policies.

C. Price Changes

If subscription prices change, we will notify you and give you the option to cancel.

10. User Responsibilities

You agree to:

    • Use the app only for lawful purposes

    • Not misuse, attack, or overload our systems

    • Not upload content that is abusive, hateful, illegal, or harmful

    • Not impersonate another person

    • Not attempt to access or collect data that does not belong to you

We may remove content or suspend accounts that violate these rules.

11. Third-Party Services

HealthPhi may connect to:

    • Apple Health / HealthKit

    • Electronic health record systems (FHIR)

    • Fitness devices

    • Nutrition databases

    • Cloud services (AWS)

These services have their own rules.
HealthPhi is not responsible for their availability or accuracy.

12. Not Medical Advice (Important)

The HealthPhi app:

    • Does not diagnose health conditions

    • Does not replace medical care

    • Does not provide professional medical advice

    • Should not be used during medical emergencies

If you think you are experiencing an emergency, call 911 immediately.

13. Emergency Disclosures

If we believe you or someone else is in immediate danger, we may share limited information with emergency responders.
We will share the minimum necessary to help keep you safe.

14. Data Security & Privacy

Your use of HealthPhi is also governed by our Privacy Policy, which explains:

    • What data we collect

    • How we use it

    • How we protect it

    • Your rights

By using HealthPhi, you agree to the Privacy Policy.

15. Ending Your Use of HealthPhi

You may delete the app and stop using HealthPhi at any time.
You may also request account deletion by emailing privacy@healthphi.info.

We may suspend or terminate accounts that violate these Terms or pose a security risk.

16. Changes to These Terms

We may update these Terms to:

    • Improve the app

    • Comply with laws

    • Add new features

    • Address security needs

If changes are significant, we will notify you in the app or by email.

17. Limits on Our Liability

To the fullest extent allowed by law:

    • HealthPhi is provided “as is” and “as available”

    • We do not guarantee accuracy of insights or data

    • We are not responsible for delays, errors, outages, or data from external sources

    • We are not liable for indirect, incidental, or consequential damages

    • Our total liability will not exceed the amount you paid to use the app in the last 12 months

Some states do not allow these limits, so they may not apply to you.

18. Governing Law

These Terms are governed by the laws of New York, and any disputes must be brought in New York state or federal courts.
